TERMS OF SERVICE

By accessing or using our Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have the authority to bind that organization to these Terms.

SEKYURITI provides software build protection services, including but not limited to: encryption of software builds, access code management, validation services, and related tools (collectively, the "Service").

The Service requires an active internet connection for validation purposes. Protected software builds require successful validation against our servers to function. We do not guarantee uninterrupted availability of validation services.

To use certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately upon becoming aware of any unauthorized use of your account.

We reserve the right to refuse service, terminate accounts, or remove or edit content at our sole discretion.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business purposes.

You may not: (a) copy, modify, or distribute the Service; (b) reverse engineer, disassemble, or decompile the Service or attempt to derive its source code; (c) rent, lease, lend, sell, or sublicense the Service; (d) remove or alter any proprietary notices on the Service; or (e) use the Service for any unlawful purpose.

You retain all rights to the software builds and content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, store, and transmit User Content solely for the purpose of providing the Service.

You represent and warrant that: (a) you own or have the necessary rights to submit User Content; (b) User Content does not violate any third party's intellectual property or other rights; and (c) User Content complies with all applicable laws and these Terms.

You agree not to use the Service to:

(a) Submit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable;

(b) Submit any malware, viruses, or malicious code;

(c) Infringe upon or violate the intellectual property rights or other rights of others;

(d) Attempt to circumvent, disable, or interfere with security-related features of the Service;

(e) Use automated means to access the Service without our express written permission;

(f) Interfere with or disrupt the Service or servers or networks connected to the Service.

Certain features of the Service may require payment. You agree to pay all fees associated with your selected plan. Fees are non-refundable except as required by law or as explicitly stated in these Terms.

We reserve the right to change our fees upon thirty (30) days' notice. Your continued use of the Service after a fee change constitutes your agreement to pay the new fees.

Subscription services will automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. Protected builds associated with your account will no longer validate successfully after termination.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

IN NO EVENT SHALL SEKYURITI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless SEKYURITI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third party right, including any intellectual property right; or (d) any User Content you submit.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive relief in any court of competent jurisdiction.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
